Is No-Fault Divorce a Good Idea?

In 1970, California became the first state to permit “no fault” divorce. Under the new law, it was no longer necessary for one spouse to plead and prove grounds for divorce. It was sufficient to allege “irreconcilable differences.” In other words, either spouse could obtain a divorce, regardless of fault, merely by insisting that he or she no longer wished to be married to the other spouse. Eventually, no-fault divorce spread to most of the rest of the country, although there are some exceptions (e.g. New York).

It has been 40 years since no-fault divorce was first instituted. Do you think it is a good idea or a bad idea? What effect do you think it has had on our society? Should a spouse be required to plead and prove the existence of grounds for divorce (e.g. adultery, desertion, cruelty, etc.), or should it be sufficient to permit a spouse to obtain a divorce if he or she no longer wishes to be married to the other spouse?

To the extent that it enables persons in bad and abusive relationship get out of the relationship quick and easy, it is good. It does however, reduce the value and sanctity of the institution of marriage, but this is only a moral judgment. We live in a society that is gradually destroying everything of value or ideal in the name of individual rights. Marriage in our society has become a thing of experiment, test and trial, get into it and experiment with it, as long as you like it you stay in it, the moment you do not like it, you get out of it, no commitment.

I think we should not have the institution of marriage or marriage laws but should instead have renewable marital contract, that will enable persons sign and enter into a marital contract for weeks, months, or years, renewable as long as they agree. Since we live in a permissive society, this contract can be entered into between a man and a woman, a woman and a woman, or a man and a man, the peoples’ choice.
